According to acclaimed legal expert Alan Dershowitz, Manhattan District Attorney Alvin Bragg’s rumored upcoming prosecution of President Donald J. Trump is based on “made-up laws.” Dershowitz is destroying the sick leftist goal to ruin the likely 2024 President.
The story of Trump’s detention originated from a suspected leak and filled the mainstream media’s propaganda cycle for days with speculation about what the revelation may mean for Trump’s presidential campaign.
“But even so, Dershowitz said he thinks that Trump would unlikely receive a fair trial in a city that leans heavily blue,” Gary Bai reported for the Epoch Times, adding:
The expert responded to news that Trump may soon be indicted on charges related to the payment of hush money to adult film actress Stormy Daniels. Trump would be the first former president to face criminal charges.
Michael Cohen, a former Trump attorney, paid Daniels $130,000 days before the 2016 presidential election in return for her quiet on allegations that she had an affair with Trump years before, which the former president denies. Cohen pled guilty in 2018 to violating federal campaign finance rules for arranging payments to Daniels and another woman who claimed to have had an affair with Trump. Cohen believes he did so at Trump’s behest and that the Trump Organization compensated him for ordinary legal bills.
The outlet continued:
Trump has denied any wrongdoing and claimed that he is the victim of blackmail.
Bragg’s criminal case appears to revolve around whether Trump fabricated company documents, a state misdemeanor, to conceal Cohen’s breaches of federal campaign finance law.
“Nobody should ever be arrested based on made-up laws or combining a federal and state statute,” Dershowitz told The Epoch Times in an interview on March 18. “I taught criminal law for 50 years at Harvard, and the one rule was, no creativity is permitted by prosecutors. The law has to be clear.”
Judge questioned Bragg’s apparent effort to raise a misdemeanor case of fabricating records to a felony by linking it to an alleged violation of federal campaign finance law.
“In order to turn the state statute into a felony, you have to borrow a federal statute,” Dershowitz told The Epoch Times in an earlier interview, on March 16. He said that this combining of laws “seems to raise real serious legal questions.”
“In Bragg’s case, what they’re trying to do is add one and one, and come up with 11,” Dershowitz said. “No rational person would look at these two statutes and say that Trump violated them.”
“Thomas Jefferson once put it very nicely: For a criminal statute to be constitutional, the average person has to be able to understand it if he reads it while running.”
